>>> Petition Presented Objecting To Rights Abuse

A petition has been presented to the Herndon Mayor by eight Sterling
District citizens and 6 others who claim their rights under the
constitution and the Va. Freedom of Information Act.

They went to the Public Hearing of the Herndon Town council and asked to
speak during the public comment time of the Hearing as it was posted for
early in the evening at the beginning as usual.

I have reviewed the petition and know the citizens to be long time
residents of Sterling and they are upset when the Herndon Town Council
published a time certain for public comment and then moved it without
notice to the end of the meeting.

This prevented the citizens from staying as it was clear to them that
this would require them to stay until after midnight.

This petition reports a specific disenfranchisement on a specific
evening and documents a large number of citizens who report that their
rights have been violated. This is a serious matter that should not be
taken lightly by anybody and certainly not this elected official.

I have written the Loudoun county attorney to advise me how to protect
the rights of our citizens and what action we should take. I have
prepared a lengthy layman's opinion and presented this to the members of
the Fairfax Board of Supervisors (Herndon is part of Fairfax) and the
Herndon Town Council to warn them that this is a serious matter.

In summary, I believe citizens have a right to petition government and
to be able to participate in an open public hearing. Sterling Americans
are not to be treated with disrespect and they are now hearing from me
as a result of this wrongful action.

>>>>BREAKING HARD
>>> OBVIOUS PATTERN OF ABUSE FEARED

After I wrote my inquiry and preliminary opinion I have learned that
there are other incidents of petty abuse of Sterling citizens in order
to discourage them from going to Herndon in order to testify at public
hearings.

This involves making our citizens wait in lines in public in the heat
and for hours for no reason what so ever. Cutting them off when talking
and going past midnight (most local governments recess to another
evening at 12 midnight) and holding large meetings in small rooms when
large rooms are available.

I hope that these reported incidents of abuse do not continue. I plan on
going to Herndon in order to investigate these incidents at their August
16 meeting. (see details below)

WHAT is Loudoun County's Current Position?

These public documents outlined how Loudoun County is opposed to the day
labor site.

>>>>>BOWERS, ROBERTS, ARTMAN SAY SITE NOT ZONED PROPERLY

Since the proposed site is located partly in Loudoun County (near
Sterling District, County Administrator Kirby Bowers has written the
Town of Herndon a letter informing them that Loudoun must be included
and the Loudoun County Zoning Administrator Melinda Artman has issued an
Informal Opinion that the proposed site would require a special
acceptation granted by the full Board of Supervisors, so unless Herndon
asks for one, they are operating outside of the law.

>>>> IS IT THE RIGHT THING? MOST OF YOU SAY "YES"

53 OF YOU WROTE AND SAID "IT IS THE RIGHT THING. OPPOSE THE DAY LABOR
SITE". 3 wrote and said "support the day labor site". So most of you
want me to "Oppose the Day Labor Site".
Thank you all for writing me. I appreciate hearing from you and will
take time to quote some of you in the next newsletter.

On Tuesday, August 16 I will go to the Town Council of Herndon and ask
them again to cease and desist the actions to build a day labor site. I
will go there at 5:30 p.m. and encourage citizens waiting on line and at
6:00 p.m. will talk to some news media reporters who have requested to
hear my views on the day labor center.

If you have not yet, please Tell me "Oppose the Day Labor Site" or
"Support the Day Labor Site". or "Do Nothing about the day labor Site"
.Thank you.

>>> NATIONAL NEWS MEDIA AND DELGAUDIO

I have been receiving emails about The Associated Press story on my
announced reaction to certain revelations about the Supreme Court
nominee, John Roberts. This AP story was in 150 newspapers.

Discussions continued every day on national news talk shows on radio and
television about what Conservatives should expect and demand in a
Supreme Court nominee. I participated in 10 such debates or forums on
radio in 10 cities. These discussions would not have taken place at all
had I remained silent. And they continue. No money from the campaign or
money from the taxpayers was used for any of these discussions. The news
media called me and I appeared for free.

I hope I can continue in these successes with your help. Thank you all.
